L\u2019arbitrage est le processus par lequel les parties engagent une tierce personne d\u2019entendre et de d\u00e9cider de leurs diff\u00e9rences. Le processus peut \u00eatre obligatoire, comme pour les arbitrages en droit du travail, ou discr\u00e9tionnaire, comme pour les arbitrages de droit de l\u2019emploi ou en litige civil.<\/p>\n

L\u2019arbitrage a de multiples avantages compar\u00e9s au litige devant les Cours. Le processus arbitral est moins formel, et souvent moins long et moins couteux. Les parties et l\u2019arbitre sont souvent en mesure de s\u2019entendre sur la fa\u00e7on la plus efficace et pratique d\u2019entrer en preuve les documents et les t\u00e9moignages. Une d\u00e9cision est souvent rendue plus rapide qu\u2019une d\u00e9cision judiciaire.<\/p>\n

De plus, une d\u00e9cision arbitrale n\u2019est pas sujette \u00e0 un appel, contrairement aux d\u00e9cisions judiciaires. Elle est aussi largement \u00e0 l\u2019abri d\u2019une r\u00e9vision judiciaire. Les d\u00e9cisions arbitrales sont cens\u00e9es d’\u00eatre finales et elles le sont presque toujours.<\/p>\n

The process can be mandatory, as is the case for labour arbitrations, or optional, as is the case for employment or civil litigation matters. \r\n\r\nArbitration has multiple advantages to the alternative of Court based litigation. The parties choose the arbitrator, usually on the basis of expertise and experience. The process is less formal than Court and is often less lengthy and more cost-efficient. The parties and the arbitrator are often able to agree on methods to introduce evidence in the most efficient manner. It is usually possible to have a matter decided by arbitration more quickly than would be the case for the Courts. Arbitral decisions are not subject to appeals, unlike Court cases, and are substantially protected from successful judicial review.
